§ 1 Scope

(1) The following terms and conditions are written in German and can be downloaded and printed by the customer. Upon request, they can be obtained in digital or written form at ayurveda.eu and maharishiayurveda.de or by emailing map@ayurveda.eu.

(2) Maharishi Ayurveda Europe B.V. (hereinafter also referred to as the seller) operates a website for commercial purposes under the domains ayurveda.eu and maharishiayurveda.de. Maharishi Ayurveda Europe B.V. offers products for purchase over the internet to customers on these pages. Maharishi Ayurveda Europe B.V. also publishes a printed catalog and offers its goods for order through this channel.

(3) These general terms and conditions are an integral part of every contract concluded between a customer who is a consumer within the meaning of § 13 BGB and has their residence in the Federal Republic of Germany, and Maharishi Ayurveda Europe B.V. These terms and conditions do not apply to customers residing in the Netherlands or other countries. Orders from customers not residing in Germany must be placed via the language navigation on www.ayurveda.eu, where the corresponding terms and conditions are also available.

(4) These General Terms and Conditions also do not apply to commercial resellers. These are expressly referred to the corresponding catalog and conditions, which can be requested from Maharishi Ayurveda Europe B.V.

§ 2 Product selection

(1) The customer has the option to select and order products on the aforementioned website.

(2) For each product, the customer receives a separate product description on the respective website.

(3) The customer can click on the desired products on the website. These are collected in a virtual shopping cart and at the end of their purchase, the customer receives a compilation of the products with the total final price including VAT.

(4) Before sending the order, the seller allows the customer to check the content of the order for accuracy, especially regarding price and quantity, and to correct it if necessary.

§ 3 Right of withdrawal for consumers

Consumers are entitled to a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity:

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.
To exercise your right of withdrawal, you must inform us (Maharishi Ayurveda Europe B.V., Looskade 20, 6041 LE Roermond, Netherlands, Tel.: 0800 22907472, Email: map@ayurveda.eu) by means of a clear statement (e.g. a letter sent by post, or email) of your decision to withdraw from this contract. You can use the attached sample withdrawal form, which is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no event will you incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back or hand over the goods to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You shall bear the direct cost of returning the goods. We will cover the return costs for customers from Germany if you send the goods with Deutsche Post / DHL to the address below:

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

§ 4 Exclusion or premature expiry of the right of withdrawal

The right of withdrawal does not apply to contracts:

  • for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer,
  • for the supply of goods that can spoil quickly or whose expiry date would be quickly exceeded,
  • for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons if their seal has been removed after delivery,
  • for the supply of goods if these have been inseparably mixed with other goods after delivery due to their nature.

You may also send the goods to our business premises in the Netherlands. Further details for simplifying the return process are explained on a return slip enclosed with the goods.

§ 7 Prices, payment terms and shipping costs

(1) The list prices at the time of the order, as shown on the internet pages, shall apply.
(2) The stated prices are ex-seller's premises, including VAT, excluding packaging and shipping costs.
(3) You can find the shipping costs in the current calculation and overview in the shop system and under the link Shipping Costs, as well as during your purchase before sending the order.
(4) The purchase price is due without deduction within eight days of invoicing.

§ 8 Conclusion of contract

(1) The seller's offers on the website are non-binding. The presentation of the product range in the online shop does not constitute a binding offer. Therefore, Maharishi Ayurveda Europe B.V. is not obliged to perform in case of unavailability. By placing your order, you submit a binding offer.
(2) A contractual obligation regarding the individual services arises when the seller has confirmed the customer's order in text form.

§ 9 Execution of the contract

(1) After processing the order, the customer will receive a binding order and order confirmation.
(2) The delivery time is 2 to 4 working days. For payment in advance, the delivery period begins on the day after the payment order is issued to the transferring credit institution; for other payment methods, it begins on the day after the contract is concluded and ends with the expiry of the last day of the period. If the last day of the period falls on a Saturday, Sunday, or a public holiday recognized by the state at the place of delivery, the next working day shall take the place of such a day. If not all ordered products are in stock, we are entitled to make partial deliveries at our expense, provided this is reasonable for you. Any additional costs arising from this shall be borne by the seller.
(3) Only insured shipments will be dispatched, regardless of the size and price of the product. Other shipping methods are not used. For shipping to a consumer as a buyer, the seller is legally liable for the shipping route.

§ 10 Payment

(1) The seller will issue an invoice for the ordered goods to the customer, which will be handed over upon delivery of the goods. The seller delivers against payment via PayPal, bank transfer in advance, and possibly other payment methods specified in the order process.
(2) Prices on the invoice are always end-customer prices including VAT. The VAT will be shown separately.

§ 11 Warranty

Information on liability for defects: Statutory liability for defects applies.

§ 12 Complaints/Service Hotline, further consumer information

Maharishi Ayurveda Europe B.V. provides a hotline for customer questions and complaints regarding products and services. This hotline is available to customers on weekdays (Monday to Friday), from 10:00 AM to 12:00 PM and from 2:00 PM to 4:00 PM, under the telephone number +31 475 529111 and 0800 2297472. You can also reach Maharishi Ayurveda Europe B.V. at the email address: map@ayurveda.eu.
The acceptance and processing of complaints do not limit your statutory warranty rights.
We are not subject to any special codes of conduct not mentioned above. Delivery under these General Terms and Conditions is only made to consumers in Germany.

§ 13 Liability

The seller is liable in cases of intent or gross negligence in accordance with statutory provisions. Liability for guarantees is independent of fault. For slight negligence, the seller is liable exclusively in accordance with the provisions of the Product Liability Act, for injury to life, body or health, or for the breach of essential contractual obligations. However, the claim for damages for the slightly negligent breach of essential contractual obligations is limited to the foreseeable damage typical for the contract, unless liability exists for injury to life, body or health. The seller is liable to the same extent for the fault of vicarious agents and representatives.
The provision of the preceding paragraph extends to damages in addition to performance, damages instead of performance, and the claim for compensation for futile expenses, regardless of the legal reason, including liability for defects, delay or impossibility.

§ 14 Force Majeure

(1) In the event that the seller is unable to provide the owed service due to force majeure (natural disasters, etc.), the seller is released from its performance obligations for the duration of the impediment.
(2) If the seller is unable to execute the order or deliver the goods for more than one month due to force majeure, the customer is entitled to withdraw from the contract.

§ 15 Data Protection

Collection, processing and use of personal data We store the contract text and send you the order data and our General Terms and Conditions by email. You can view the General Terms and Conditions at any time on our website. You can view your past orders in our customer login area.

You can visit our site without providing any personal information. We only store access data without personal reference, such as the name of your internet service provider, the page from which you visit us, or the name of the requested file. This data is evaluated exclusively to improve our offer and does not allow any conclusions about your person.

Personal data is only collected if you voluntarily provide it to us as part of your goods order or when opening a customer account or registering for our newsletter.
